Petitioner seeks bail in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
Allegation against the petitioner is that he took about rupees six lakhs from the informant to manage Visa for the informant to send him to any foreign country for job. Submission of the learned counsel for the petitioner is that the false allegation is there for the reason that the informant is Director of Omega International Overseas Consultancy Private Limited vide Annexure-2 series and both were doing joint business vide Annexure-3 series. Thereafter account was settled between the two partners vide Annexure-4 and
Patna High Court Cr.Misc. No.61462 of 2017 (2) dt.21-12-2017 2/2 the money was paid through the referred cheque as settlement amount and the petitioner still have dues with the informant. Learned counsel for the informant opposed the prayer for bail.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kankarbagh Police Station Case No. 510 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
