JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-08-2015 The present application has been filed for modification of the order dated 23.04.2012 passed in Cr. Misc. No. 14607 of 2012 for extending the period of surrender and deposit of Rs. 1,75,000/-.

The petitioner was granted anticipatory bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code and Sections 135/138 of the Electricity Act.

The accusation was consumption of electricity energy unauthorizedly. The loss was calculated to the tune of Rs. 3,43,196/-.

It is submitted by learned counsel for the petitioner that petitioner failed to deposit the aforesaid amount but now the petitioner is ready to deposit the amount of Rs. 1,75,000/- within a period of three weeks before the Electrical Executive Engineer, Kaimur at Bhabua.

Patna High Court Cr.Misc. No.37898 of 2014 (2) dt.19-08-2015 2/2 Mr. Vinay Kirti Singh, learned senior counsel for the South Bihar Power Distribution Company has no objection in extending the period of surrender provided the petitioner deposits the alleged amount of Rs. 1,75,000/-. The order dated 23.04.2012 passed in Cr.

Misc. No. 14607 of 2012 is modified to the extent that period of surrender is extended by four weeks from the date of receipt/production of the copy of this order. The bail bonds of the petitioner shall be accepted on showing proof of deposit of Rs. 1,75,000/- before the Electrical Executive Engineer, Kaimur at Bhabua.

Accordingly the modification application is disposed of in connection with Mohania P.S. Case No. 11 of 2011, pending in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabua.
