JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 01-12-2017 Heard learned counsel for the petitioner and the State. The grievance of the petitioner is confined for posting after revocation of the order of suspension.

Counsel for the petitioner submits that the order of suspension was revoked on 10.11.2016 (Annexure-3), but even after one year of revocation of suspension the petitioner has not been given posting.

Counsel for the State submits that the order of suspension of the petitioner was revoked and in view of the revocation order of suspension, the petitioner would be given posting by the competent authority at the earliest.

Patna High Court CWJC No.633 of 2017 dt.01-12-2017 2/2 Considering the fact that the petitioner's suspension was revoked way back on 10.11.2016 (Annexure-3), there is no justification not to post the petitioner even after revocation of suspension, which was passed more than one year back. Under the aforesaid circumstances, the District Programme Officer (Establishment), Lakhisarai is directed to pass appropriate order for posting of the petitioner within a fortnight from today. In case, the petitioner is not given posting within the aforesaid period, liberty shall be available to the petitioner to file a petition for revival of this writ application.

With the aforesaid, the writ application stands disposed of.
