The petitioner apprehends his arrest in Mohania P.S. Case No. 191 of 2015 registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code. Allegation against the petitioner is that while the petitioner Suryadev Narayan Pathak and Vijay Kumar Singh were Branch Manager of Madhya Bihar Gramin Bank, Lahuribari branch one Ravikesh Sharma the agent was working as a staff of the bank after taking user ID transferred money of different account holders to his own account and the accounts of his relatives.
It is submitted that, of course, the petitioner was Branch Manager of the bank during the relevant period but there is no
Patna High Court Cr.Misc. No.33756 of 2015 (4) dt.21-06-2016 2/2 allegation against the petitioner. It was Ravikesh Sharma who got money transferred in his own account and the accounts of his relatives by using user ID. Departmental proceeding was held and the petitioner was punished with stoppage of some increments. Similarly Vijay Kumar Singh another Branch Manager was also punished with stoppage of increments and Vijay Kumar Singh has already been granted anticipatory bail vide order dated 23.07.2015 passed in Cr. Misc. No. 28737 of 2015. The case of the petitioner stands on similar footing.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur (Bhabhua) in Mohania P.S. Case No. 191 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
