JUSTICE MADHURESH PRASAD ORAL ORDER 12-12-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This is a case registered for the offence punishable under Sections 323, 341, 324, 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Only one Mr. Pathak is said to be accused in the First Information Report. It has been submitted by learned Counsel for the petitioner that one Ranjeet Pathak, coaccused in this case, has been allowed bail vide order,

Patna High Court Cr.Misc. No.55658 of 2017 (2) dt.12-12-2017 2/3 dated 28.03.2016, passed in Cr. Misc. No. 56385 of 2015. The petitioner's name has appeared in this case on the basis of confessional statement of one Rishikesh Yadav @ Rishikesh Kr. Yadav. His application for bail has also been allowed, which is evident from Annexure 3 of the petition, i.e., order, dated 24.05.2016, passed in Cr. Misc. No. 17034 of 2016. Annexure 4 of this petition is bail order of another co-accused, namely, Kajal Kumari @ Kajal Jha. The petitioner is said to be a man of clean antecedent and he is in custody since 26.07.2017. The investigation in the instant case is complete and the charge-sheet has also been submitted.

Considering the aforesaid submissions, the prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar P.S. Case No. 316 of 2015, subject to the conditions:

(i) That one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in
