Petitioner seeks bail in Motipur P.S. Case No. 265 of 2018 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code read with Section 25(1B)a/26/35 of the Arms Act. Allegation against the petitioner is of recovery of one unloaded country made pistol and 4 live cartridges from the possession of the petitioner.

It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent and is in custody since 12.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon

Patna High Court Cr.Misc. No.50309 of 2018(2) dt.30-08-2018 2/2 furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, West, Muzaffarpur, in connection with Motipur P.S. Case No. 265 of 2018.
