JUSTICE SANDEEP KUMAR ORAL ORDER 07-12-2021 Heard learned Senior Counsel for the petitioner and learned Additional Public Prosecutor for the State as well learned counsel appearing on behalf of the informant. The petitioner apprehends his arrest in connection with Ratanpura P.S. Case No. 69/2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Learned Senior Counsel for the petitioner submits that the petitioner was found sitting in the house of the main accused Shankar Paswan. One witness, namely, Uday Yadav has given statement that he had also visited the house of Shankar Paswan along with the deceased and after staying there for 15-20

Patna High Court CR. MISC. No.20582 of 2020(5) dt.07-12-2021 2/3 minutes, he left. He is a witness to that point only. It is further submitted by learned Senior Counsel that apart from that suspicion, there is no material to connect this petitioner with the present crime.

Learned Additional Public Prosecutor assisted by learned counsel for the informant has submitted that the petitioner was found sitting in the house of Shankar Paswan and the vehicle of Shankar Paswan was found parked in front of the petitioner's house for two days.

There is no evidence that the deceased was killed in the house of Shankar Paswan and the petitioner had participated in the crime. There is no evidence that the deceased was transported in the vehicle of the petitioner. There is no evidence collected by the Investigation Officer that petitioner is connected in this case even remotely.

Considering the facts and circumstances of the case, the present anticipatory bail application is allowed. Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned
