The petitioner is languishing in custody since 19.12.2018 in a case registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act, 1959. The prosecution case is that from the possession of the petitioner, two live cartridges were recovered. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. A statement has been made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP for the State submits that the recovery
Patna High Court CR. MISC. No.17275 of 2019(2) dt.27-03-2019 2/2 has been made from the conscious physical possession of the petitioner and the petitioner is named in the FIR. Considering the nature of recovery and period under custody, coupled with statement made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, West Champaran at Bettiah in connection with Chanpatia P.S. Case No.516 of 2018.
