2. It is agreed between the parties, that the provisional pension to the petitioner shall be paid in terms of the statutory provision within two months from today, if already not done. However, with regard to the final payment/fixation of pension, the same shall abide by the statutory provision relating to departmental /criminal proceeding pending.

3. The writ petition stands disposed off.

The parties are informed that the court fee, if any, paid by any of them shall be refunded.
