The petitioner seeks regular bail in Sessions Trial No.531 of 2017 arising out of Mairwa P.S. Case No. 166 of 2017 registered for the offence under Sections 394, 302/34 of the I.P.C. and Section 27 of the Arms Act.
Petitioner is not named in the F.I.R. Later on he was arrested on the basis of confessional statement of co-accused. Submission of the learned counsel for the petitioner is that prayer for bail was rejected on the ground that he has criminal antecedents and he is in custody since 6.6.2017 and five cases are against him which will appear from impugned order. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.62539 of 2017 (2) dt.11-01-2018 2/2 circumstances, as stated above, and it is also submitted that impugned order shows that the charge has been framed in this case, at this stage I am not inclined to grant bail to the petitioner. However, since the charge has been framed, learned trial court is directed to expedite the trial and preferably conclude it within a period of six months and, if not concluded, the petitioner will be at liberty to renew his prayer for bail which will be considered on the basis of materials available on the record at that time without being prejudiced by this order.
With the aforesaid observation this application is dismissed.
