====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2022 CRIMINAL MISCELLANEOUS No.16825 of 2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code and Section 66(C) (D) of the I.T. Act.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the case relates
3/11 to Cyber Crime in which several of the accused have been granted anticipatory bail, Prince Kumar has been granted anticipatory bail by Order Dated 05.09.2022 in Cr. Misc. No. 19510 of 2022. Learned counsel next submits that even from perusal of the allegation as alleged in the FIR it would manifest that no specific allegation is alleged against him, it is next submitted that allegations are general and omnibus in nature, it is also submitted that purpose of arrest is only arises when an accused evades law or does not cooperate in the investigation but the petitioner is ready and willing to cooperate in the investigation and will present himself before the investigating officer of the case as and when called for by the investigating officer.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case
4/11 is pending/successor court in connection with Giriyak P.S. Case No. 16 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
One of the bailor shall be the father of the petitioner Sheo Nandan Singh.
Further, in the event, if the investigating officer of the case files an application before the learned trial Court bringing to its notice that the petitioner despite giving assurance to this Court is not cooperating in the investigation or is not presenting himself when called the learned trial Court after giving an opportunity of hearing to the petitioner shall pass orders in accordance with law and shall also have liberty to cancel his bail bonds.
The learned trial Court is directed to send the copy of this Order to the concerned P.S.
