JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2017 The petitioner seeks regular bail in connection with Dulhin Bazar P.S. Case No. 156 of 2017, registered for offences punishable under Sections 20, 22, 23 and 24 of NDPS Act. Allegation against the petitioner is of recovery of 2.5 kg of ganja.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, the quantity recovered is well below the commercial quantity. Further petitioner has been in judicial custody since 06.07.2017 and though he is accused in one case but he is on bail in that case. Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case and nature of allegation, at this stage, I

No.55050 of 2017 (2) dt.20-11-2017 am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to expedte the trial and try to conclude it within a period of five months and if the trial is not concluded within the aforesaid period, the court below shall release the petitioner on bail to his own satisfaction with an undertaking that he shall cooperate in the disposal of trial and shall remain present on each and every date except on some exceptional/genuine grounds.
