Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 21.7.2017 passed in Cr. Misc. No.30844 of 2017 on merit and now the second application has been filed on behalf of the petitioner stating that only on the suspicion he has been made accused in this case and there is nothing against him. He is in custody for ten months. Heard learned A.P.P. also.
Having heard both sides and in view of fact that his prayer for bail has already been rejected on merit, I am not inclined to interfere with the earlier order as the prayer for bail of the petitioner has been rejected on merit, however since the petitioner is in custody since long, the learned trial court is
Patna High Court Cr.Misc. No.55682 of 2017 (2) dt.22-11-2017 2/2 directed to expedite the trial of the petitioner and try to conclude it as soon as possible.
With the aforesaid observation, this application is dismissed.
