JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Complaint case No. 521C of 2014, disclosing offences under Sections 467,468,471,474 and 420 of the Indian Penal Code. I do not find any reason why this Court should exercise discretion under Section 438 of the Code of Criminal Procedure when the Magistrate before whom the matter is pending is required to consider petitioner's case for grant of bail, in the light of decision of this Court dated 14.5.2015 passed in Cr. Misc. No. 51075 of 2014 reported in 2015(3) BBCJ (V)53 (Salim Ansari and others vs. State of Bihar and others).

No.32647 of 2015 (2) dt.14-08-2015 This application is disposed of with an observation that if the petitioner, in response to the summon issued to him, appear before the learned Magistrate, the learned Magistrate shall pass an order on his application for bail in the light of the said decision of this Court in Case of Salim Ansari and others (supra). This application stands disposed of.
