The petitioner seeks bail in connection with Khagaria (Muffasil) P.S. Case No. 925 of 2019 registered under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The accusation is that on receiving secret information about gathering of some persons engaged in selling the arms and ammunitions at Sansarpur Dhala on National Highway No. 31, the informant, along with other police officials, reached there, where three persons were seen in suspicious condition, then, they were apprehended. On query, they disclosed their names Chandan Kumar, Mannu Kumar and Brajendra Kumar. Chandan Kumar was found with one bag containing 45 packets, each containing 10 cartridges, Mannu Kumar was found in

Patna High Court CR. MISC. No.15962 of 2020(2) dt.03-06-2020 2/2 possession of three packets, each containing 20 cartridges whereas Brajendra Kumar was found in possession of four packets, each containing 20 cartridges.

Submission is that the petitioner has no criminal antecedent and is in custody since13.12.2019. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Khagaria (Muffasil) P.S. Case No. 925 of 2019 to the satisfaction of the Chief Judicial Magistrate, Khagaria, subject to the conditions that out of two bailors, one must either be parent or close relative of the petitioner.
