The petitioner seeks bail in Bihiya P.S. Case No. 324 of 2021, registered for the offence punishable under Section 395 of the Indian Penal Code.
As per the prosecution case, six unknown persons on the point of pistol committed loot and snatched cash of Rs. 38,500/- and mobile from possession of the informant. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the information of spy. No incriminating article has been recovered from possession of this petitioner. Petitioner is in custody since 13.09.2021. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 5th, Bhojpur at Ara in connection with Bihiya P.S.
