JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

It is alleged that the petitioner being PDS dealer, in 2006-07, lifted 342.92 quintals of grains under Food for Work Scheme worth Rs.4,69,800/- but in spite of direction to deposit the said money was not deposited.

It is submitted by the learned counsel for the petitioner that subsequently after leaving the PDS dealership, the petitioner joined as a teacher in a school.

Considering the fact that the case was instituted in 2011 and earlier anticipatory bail application was rejected by the

Patna High Court Cr.Misc. No.32008 of 2015 (2) dt.06-08-2015 2/2 learned Sessions Judge, this court is not inclined to interfere. However, if the petitioner deposits the alleged due amount of Rs.4,69,800/- before appropriate authority within a period of three months, the learned court below will consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Raja Pakar (Baranti) P.S. Case No. 145 of 2011 pending in the court of learned C.J.M. Vaishali at Hajipur.

This application is disposed of with the aforesaid observation/direction.
