KUMAR ORAL ORDER 29-08-2018 Heard learned counsel for petitioner, learned counsel for informant and learned counsel for the State. Petitioner, who is in custody, seeks bail in connection with Nimachandpura P.S. Case No. 23 of 2018 registered for the offences punishable under Sections 302, 364, 201 and 34 of the Indian Penal Code.
Informant is the brother of deceased, who in his written complaint on 17.03.2018 has alleged that her deceased sister was a PDS dealer and on 15.03.2018 she has gone to attend meeting of PDS dealer and since thereafter she did not returned and got missing. He has suspected kidnapping of her sister, however, subsequently her dead body was recovered and name of the petitioner has surfaced on the basis of confession of her husband and his Nandosi. Patna High Court Cr.Misc. No.50312 of 2018(2) dt.29-08-2018 2/2 Rs. 4,00,000/- loan to the husband of the petitioner by the deceased and he was pressing to refund the same. Except confession made by the husband and Nandosi there is nothing incriminating material against the petitioner. Petitioner has no criminal antecedent and she is in custody since 22.03.2018. Learned counsel for the informant has vehemently opposed the grant of bail to the petitioner.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge- V, Begusarai in connection with Nimachandpura P.S.
