2. The petitioners seek regular bail in connection with Motihari Muffasil P.S. Case No. 798 of 2025, registered under Sections 103(1), 61(2), 3(5) of the B.N.S.
3. As per prosecution case, the allegation is that on 28.11.2025, accused- petitioner, namely, Birendra Paswan in Cr. Misc. No. 19416/2026 and Lalan Paswan getting the land measured. The informant son, namely Manish Kumar was not satisfied with the measurement and on 13.12.2025 was fixed for measurement. However, on 11.12.2025, the accused persons including the petitioners no. 1, namely, Bhagmati Devi and
Patna High Court CR. MISC. No.17916 of 2026(4) dt.27-05-2026 2/3 accused- petitioner, Birendra Paswan came to his door, thereafter all the above named and some unknown persons were assaulting his son. When they reached there, all the accused persons fled away. But they caught two females who could not flee away.
4. Learned counsel for the petitioner submits that the petitioners are innocent and have falsely been implicated in the present case. He further submits that the allegations are general and omnibus and have been levelled in the backdrop of a land dispute as well as dispute between both the parties. Chandan Paswan, Son of the accused, Birendra Paswan has confessed his guilt. He states that though he informed his mother, aunt and father about the occurrence. One Rupesh was interested in the work of calling Manish Kumar and two friends of Rupesh Kumar came there who stabbed Manish. He also attest his presence at the time of occurrence. But he did not assign any specific role in the occurrence. Petitioners have clean antecedent and they are in custody since 14.12.2025.
5. Learned APP for the State has vehemently opposes the prayer for bail of the petitioners.
6. Considering the age of these petitioners and absence of criminal antecedent, period of custody, this

7. Accordingly, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari /concerned court below in connection with Motihari Muffasil P.S. Case No. 798 of 2025.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner (Ansul, J) Ranjeet/- U T
