The petitioner seeks bail in a case registered under Sections-8/20 of the NDPS Act.

The prosecution case, in short, is that 50 kgs. of Ganja is recovered.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 17-05-2018. Charge sheet in this case has already been submitted. 50 kgs. of Ganja is recovered from the truck in question. On behalf of the State, it is submitted that the petitioner is named in the F.I.R. The recovered Ganja is above

Considering the aforesaid facts and circumstances, I am not inclined to release the petitioner on bail as per Section 37 of the NDPS Act. Accordingly, prayer for bail of the petitioner in connection with NDPS Case No. 01 of 2018 arising out of Barachatti P.S. Case No. 327 of 2018 is rejected. The trial court is directed to take all possible steps to conclude the trial preferably within a period of one year from the date of receipt/production of copy of this order.
