2. The petitioner seeks regular bail in connection with Gopalganj Town P.S. Case No. 713 of 2024 registered for the offence under Sections 8/20(b)(ii)(A) of the NDPS Act.

3. 18.20 grams of smack has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 07.10.2024 and claims clean antecedents.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-1, Gopalganj/concerned Court below in connection with Gopalganj Town P.S. Case No. 713 of 2024 subject to condition that:- i). Before accepting the bail-bonds of the petitioner, the Court below will verify the antecedent of the petitioner. If the petitioner is found having clean antecedent, then the bail-bonds of the petitioner shall be accepted. If the petitioner is found having criminal antecedent(s), then his bail-bonds shall not be accepted by the court below.

ii). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bond of the petitioner.
