Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-08-2020 Heard the parties through the virtual court proceeding. The petitioner apprehends his arrest in connection with Nokha (Dharampura) P.S. Case No. 243 of 2019 registered for the offences punishable under Sections 188, 278, 284, 285, 290, 291 of the Indian Penal Code and Section 15 of the Environment (Protection) Act, 1986.

Allegation against the petitioner in the F.I.R. is that the informant being the Agriculture Coordinator, Nonesara Panchayat, Block Agriculture Office, Nokha on the instruction of Senior Officer, while roaming under his work area, on 03.12.2019 at about 2:00 P.M., he found, to the west of main road of Nokha More Taigore, the buring of "PARALI" (Crop Stubble).

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel for the petitioner further submits that the petitioner has no criminal antecedent.

Learned A.P.P. for the State opposed the bail petition.

Patna High Court CR. MISC. No.16831 of 2020(2) dt.12-08-2020 2/2 Petitioner is agreed to deposit a sum of Rs.10,000/- (Rupees Ten Thousand) in the CM Relief Fund, bearing Account No.2065104000002257, IFSC Code: IBKL0002065, Bank - IDBI, Branch - Kidwaipuri, Patna.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of Sri Punit Malviya, ACJM-VI-cumSub- Judge-XIV, Sasaram, Rohtas in connection with Nokha (Dharampura) P.S. Case No. 243 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. The bail bond of the petitioner shall be accepted by the learned Court below on showing receipt of deposit of Rs.10,000/- (Rupees Ten Thousand) in the CM Relief Fund.
