====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 09-03-2018 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor.
This is a petition for grant of regular bail in connection with Jadia P.S. Case No. 58 of 2017 for offences under Sections 363, 366A/34 of the Indian Penal Code. Allegation, in brief, is that while the informant's daughter went in the night to attend the call of nature, then, she was kidnapped by the petitioner and others.
The learned counsel for the petitioner submits that this is a case of elopement as the girl lived with the petitioner for four months in Delhi and Haryana and the case was lodged after much delay; whereas the learned counsel for the State submits that minor girl has stated that she was kidnapped by the petitioner, her age is found to be fourteen years and she was
Patna High Court Cr.Misc. No.487 of 2018(3) dt.09-03-2018 2/2 examined in the All India Institute of Medical Sciences, New Delhi, and evidence of sexual assault has been found against the petitioner.
Having considered the said facts and circumstances, the prayer for bail of the petitioner is presently rejected.
The trial Court is directed to expedite the trial and preferably conclude it within one year.
