The petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 145 of 2017 Gr. No.4096 of 2017 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is that when the police had apprehended a car and searched the same, 207 liters of illicit liquor was recovered. The petitioner is said to be a passenger in the said car.

The learned counsel for the petitioner submits that the petitioner is innocent and he was only a passenger in the said car, hence no recovery has been made from his possession. The

Patna High Court Cr.Misc. No.62811 of 2017 (2) dt.17-01-2018 2/2 petitioner is in custody since 26.10.2017.

Considering the nature of accusation and the period of custody already undergone, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 50,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge II, Gopalganj in connection with Gopalpur P.S. Case No.145 of 2017 Gr no. 4096 of 2017.
