JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-08-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Bhagwanpur P.S. Case No.247 of 2019 registered under Section 379 of the Indian Penal Code.

The accusation is that the informant Rohit Kumar parked his Pulser motorcycle bearing Registration No.BR-06BM-9894 in front of Pawan Line Hotel, Satpura, situated at NH22 and entered into the Hotel to take meal. When the informant came out of the Hotel after taking the meal, he found his motorcycle not there. In the dicky of the said motorcycle, the informant had kept the paper of the motorcycle, PAN-Card, credit card, educational certificates, mobile set etc.

Patna High Court CR. MISC. No.16019 of 2020(3) dt.21-08-2020 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation of the case, eight persons including the petitioner were apprehended by the police showing the motorcycle with them regarding which Lalganj P.S. Case No.332 of 2019 was instituted on 21.09.2019. Thereafter, the petitioner was remanded in this case on 17.10.2019 and since then he is in custody in the present case. The petitioner has no criminal antecedent except Lalganj P.S. Case No.332 of 2019. More so, on investigation, the police has already submitted the charge-sheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bhagwanpur P.S.
