ANJANA MISHRA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Katihar Town P.S. Case No.208 of 2015 for allegedly having committed the offence under Sections 406, 420 and 409 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is running an agency, by name "Jeevan Jyoti Seva Sansthan, Katihar," and supplies workforce to the Government, popularly known as "Manav Bal". According to the agreement, the petitioner has to pay wages to the Manav Bal and he has to pay 90% of the total amount received from the Department to the members of Manav Bal. Learned counsel for the petitioner submits that under some misunderstanding, the present F.I.R.

Patna High Court Cr.Misc. No.31708 of 2015 (2) dt.13-08-2015 2/2 was registered though the petitioner has at the material time made necessary payments to the members of Manav Bal and they have no complaint in that regard.

Considering the aforementioned facts and circumstances and that there was no complaint from the members of Manav Dal, who have also sworn affidavits supporting the case of the petitioner, and also the fact that the agreement with the petitioner has been cancelled, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S. Case No.208 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
