ANJANA MISHRA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Nawalpur (Jogapatty) P.S. Case No.104 of 2015 for allegedly having committed the offence under Sections 341, 323, 353, 379, 427, 504 and 506/34 of the Indian Penal Code and Section 135 of the Electricity Act. Learned counsel for the petitioner submits that the father of the petitioner is running a furniture shop but due to the fact that discrepancy was found in the electricity being consumed by him, a case was registered by the investigating party against this petitioner. Learned counsel further submits

Patna High Court Cr.Misc. No.33030 of 2015 (2) dt.21-08-2015 2/2 that the father of this petitioner has already been extended the privilege of anticipatory bail in Cr.Misc. No.30741 of 2015, vide order dated 12.8.2015.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents and also that his case stands on similar footing to that of the petitioner in Cr.Misc. No.30741 of 2015, let the petitioner Bitu Kumar @ Vikki Kumar, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, District-West Champaran, in connection with Nawalpur (Jogapatty) P.S. Case No.104 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
