2. The petitioner seeks regular bail in connection with Khagaria P.S. Case No. 445 of 2024 registered for the offence under Sections 137(2), 96 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The petitioner is a woman. She, along with other co-accused persons, is accused of kidnapping the two daughters of the informant under a conspiracy and keeping them in a house. The petitioner is the mother of one of the co-accused. She is in custody since 30.12.2025 and claims clean antecedent.

4. The learned counsel for the informant has produced

No.22039 of 2026(2) dt.08-04-2026 2/2 a copy of the case diary which contains the statement of the victims recorded under Section 180 and 183 BNSS from which it appears that the victims were kidnapped and kept forcibly in a room in the house of the petitioner and the petitioner was having full knowledge of the kidnapping.

5. Considering the aforesaid facts and circumstances, this Court is not inclined to grant regular bail to the petitioner. Accordingly, this application for regular bail stands rejected with liberty to the petitioner to approach this Court again after the deposition of the victims is recorded in the trial.

6. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
