This is an application for bail in connection with Kasma P.S.Case No. 58 of 2017 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpires during course of investigation.

Submission of learned counsel for the petitioner is that only material has come against the petitioner that there was love affairs of deceased with daughter of petitioner and, as such, there is suspicion that petitioner might have killed the deceased and except that there is nothing against him and he is in custody for four months and charge sheet has been submitted in this case. Heard learned APP also.

No.55237 of 2017 (2) dt.20-11-2017 2/2 Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Kasma P.S.Case No. 58 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
