The petitioner is in custody in connection with Town (Chapra) P.S.Case No.223 of 2017 registered for an offence under Section 392 of the IPC.

It has been submitted that in course of investigation one Guddu Kumar was apprehended in Chapra Town P.S.Case No.240 of 2017 and he confessed his complicity in the present crime and on his confession, the stolen motorcycle was also recovered by the police. He further disclosed the name of this petitioner who was remanded in both the cases in which he was allowed bail in Chapra Town P.S.Case No.240 of 2017 vide Cr.Misc.No.49071 of 2017. The petitioner is in custody since 18.07.2017 and till date he has not been put on test identification

Learned APP opposed the submissions.

Considering the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri R.M.Tiwari, Judicial Magistrate, Saran at Chapra in connection with Town (Chapra) P.S.Case No.223 of 2017 (G.R.No.3755 of 2017).
