JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 31-07-2015 Learned counsel for the petitioners is permitted to correct the cause title, as prayed for. All these petitioners have approached the High Court through these writ applications, seeking a direction upon the Central Board of Secondary Education (hereinafter referred to as the "CBSE" for short) for publication of their withheld result of ClassX. All the students had appeared in Class-X

examination for the Session 2014-2015.

The examination was conducted in the month of March, 2015.

The common plea of most of these petitioners is that they were initially enrolled as students in Class-IX. Then they were promoted to Class -X. They were permitted to appear in the examination for Class -X. The results thereafter were uploaded on the system of the CBSE of 388 candidates. Initially all the result was withheld of Class -X but after grievances were raised by the students as well as their guardians and when law and order issue was created, the respondent - CBSE decided to declare the results of 212 students but results of 176 candidates was withheld. This has led to filing of the present writ applications.

A common counter affidavit has been filed on behalf of the CBSE. Many things have been alleged against the manner in which the A.V.N School has been conducting itself which led to de-affiliation by CBSE on 29.06.2013. However, the Board had

granted leeway to such candidates who were already admitted in the school to participate in examination, because they did not want to come in the way of their future.

It is also urged on behalf of CBSE that many communications were made, seeking details of records of students, so enrolled as well as the ones who were being sent up for examination, but there was lack of co-operation, if not refusal by the institution. Since the school did not take any action in this regard, the authorities were left with no option but to take the decision of non-declaration of the results of the candidates who had appeared through the school in question.

CBSE has also pleaded that there are many controversies with regard to the students, the name, the enrollment and other details that has emerged from the report, given by the committee dated 6th of June, 2015, as contained in Annexure- G to the counter affidavit.

A reading of the said report does not reflect

well, both on such institution as well as the competence of the CBSE to exercise effective control and maintain standards in conduct of examination or allowing the students under such controversial circumstances to participate in the examination. All these exercises should have been done well before such students were permitted to sit and appear for the examination. This kind of controversies cannot be allowed to be raised after the students have already sat for the examination and the time for declaration of their results arose.

It is too late in the day, therefore, to allow CBSE to declare the results partially of only 212 candidates and withhold results of 176 though all had appeared through this school in the same exercise. It will not only be inequitable but also unfair for the students, whose results have been withheld. A slugfest is on between the school and CBSE as if a point or score has to be settled at the cost of the hapless students whose future is at stake. CBSE is free to act against the school but the court will not

allow them to use the students as fodder.

The result of 176 students by CBSE should be declared within a period of two weeks from today because the data is already available with them. The writ application stands allowed with the above directions.

Before parting, the Court can only observe that CBSE should tighten their affairs as well as its supervision over such institutions so that this kind of controversy does not arise in future and such institutions do not take advantage of loopholes left open in the system.
