This is an application for bail in connection with Sadar P.S.Case No. 421 of 2017 registered for the offences punishable under Sections 143, 144, 158, 290, 414, 272, 273 of the Indian Penal Code and 25, 26, 27, 35 of the Arms Act, including 30(a) of Bihar Prohibition and Excise Act.

Allegation as per FIR is that criminals assembled in a marriage party in the house of co-accused Surendra Rai and made indiscriminate firing and it appears that petitioner was in drunken condition carrying fire arms and petitioner was arrested there. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he was not found in drunken condition and he is in custody for four months. Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail but they could not controvert the above submission.

Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III-cum-Special Judge, Excise Act, Muzaffarpur, in connection with Sadar P.S.Case No. 421 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, except showing any genuine reason, failing which his bail bond shall be cancelled.
