This is a case registered for the offence punishable under Section 392 of the Indian Penal Code. The petitioner, who is in custody since 25.08.2017 in connection with the instant case, is said to be a man of clean antecedent. The allegation made in the First Information Report against unknown persons is of snatching of some money, mobile phone and the key of motorcycle from the informant and his colleague. The

Patna High Court Cr.Misc. No.55638 of 2017 (2) dt.12-12-2017 2/2 petitioner has been arrested on suspicion and it is submitted that there is no material to connect him with the alleged occurrence.

Considering the fact that the petitioner is a man of clean antecedent and that his arrest is based only on suspicion, his prayer for bail is allowed. Let the petitioner, above named, be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Panjwara P.S. Case No. 71 of 2017, subject to the conditions:

(i) That one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled. (Madhuresh Prasad, J) Praveen-II/- U T
