Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
According to FIR, the petitioner caused injury with Kudal (Spade) to Laxman Mahto more than once. As a result whereof, Laxman Mahto died. The postmortem report would reveal that the Doctor has found three sharp cutting wounds on the parietal and head region. Petitioner is in custody since 04.06.2017.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, prayer is refused. The learned Trial Court is
Patna High Court Cr.Misc. No.57663 of 2017 (4) dt.18-01-2018 directed to expedite the trial and conclude the same preferably within a period of nine months from the date of receipt/production of a copy of this order.
Accordingly, the application is rejected in connection with Sessions Trial No. 337 of 2017 arising out K.Nagar (Srinagar) P.S.Case No. 269 of 2017 pending before the court of learned 5th Additional Sessions Judge, Purnea. (Birendra Kumar, J) Nitesh/- U T
