The petitioner has filed the present writ application for a direction to the respondent-Lalit Narayan Mithila University, Darbhanga, for payment of retiral dues i.e. pension, gratuity, earn leave, G.I.C., along with arrears of salary etc. Learned Counsel for the petitioner submits that petitioner retired from the post of Head Clerk (Office Superintendent), Marbari College, Darbhanga, on 31.01.2014. He further submits that this writ application may be disposed with direction to the respondent no. 3, the Registrar, Lalit Narayan Mithila University, Darbhanga, to consider the representation of the petitioner and dispose the same in

Patna High Court CWJC No.6793 of 2020(5) dt.03-09-2021 2/2 accordance with law.

Learned Counsel for the University has got no objection.

Having heard learned Counsel for the parties, the petitioner is permitted to file a fresh and detailed representation raising his claim before the respondent no. 3, the Registrar, Lalit Narayan Mithila University, Darbhanga, within a period of one month from today and respondent no. 3, the Registrar, Lalit Narayan Mithila University, Darbhanga, is further directed to consider and dispose the representation filed by the petitioner within a period of three months from the date of filing of the representation.

Needless to say that if any amount is found payable to the petitioner, the same shall be paid by the respondent-Lalit Narayan Mithila University, Darbhanga, to the petitioner within a period of two months from the date of disposal of the representation.

With the aforesaid observation and direction, this writ application is disposed.
