JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-02-2015 The anticipatory bail application of petitioner no. 2 has already been disposed of since he was arrested. Heard learned counsel for the petitioner no. 1 and the State.
The petitioner no. 1 is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 307/34 of the Indian Penal Code and 3(I) (X) of the S.C./S.T. (Prevention of Atrocities) Act.
It is alleged that Rajesh Sah cause injury with farsa on the head of the informant when Chunnu Sah pulled sari of the informant and petitioner no. 2 abused by calling caste name.
It is submitted by the learned counsel for the petitioner no. 1 that the informant has retracted from the initial
Patna High Court Cr.Misc. No.32487 of 2014 (3) dt.06-02-2015 version and filed a petition to that effect before learned court below.
Considering that the petitioner no. 1 is a lady and the retracted stand of informant, let the above named petitioner no. 1 be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Katihar in connection with kursela P.S. Case No. 48 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
