2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 504, 506 and 307 of the Indian Penal Code.
3. As per prosecution case, it is alleged that this petitioner assaulted on head of husband of informant by means of Sword.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has been falsely implicated in this case. As a matter of fact, due to admitted land dispute between the parties, a free fight took place in which both sides sustained injuries. There is case and counter-case between the parties. Charge-sheet has already been submitted and
Patna High Court CR. MISC. No.21081 of 2025(2) dt.16-05-2025 2/2 petitioner is in custody since 17.11.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation, case and counter-case between the parties and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Phesar P.S.
