Petitioner seeks bail in a case registered for the offences punishable under Section 363A, 366A of the Indian Penal Code and Under Section 4 of POCSO Act.

The FIR was lodged with allegation that the minor daughter of the informant was kidnapped by the petitioner. The victim girl in her statement under Section 164 of the Cr.P.C. stated that she had love affair with the petitioner and she had voluntarily gone with the petitioner. Even if it assumed for the argument sake that the victim was a minor, she has not alleged anything like kidnapping or abduction against anyone.

Hence, let the petitioner, above named, be

Patna High Court Cr.Misc. No.58587 of 2017 (2) dt.18-12-2017 released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Deodha Police Station Case No.27 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
