2. The petitioner has preferred this application for grant of regular bail in connection with Kasba P.S. Case No. 78 of 2024 dated 23.03.2024 registered for the offences punishable under Section 304B read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner (husband) and the other co-accused persons are alleged to have killed the daughter of informant due to non-fulfillment of demand of Rs. 2 lacs and a motorcycle as dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.18558 of 2025(3) dt.14-07-2025 2/3 this case. There is general and omnibus allegation against the petitioner who is husband of the deceased. In fact, the petitioner was not present at the place of occurrence rather he was selling vegetable in Kasba Market. The petitioner neither demanded any dowry nor tortured the deceased. It is further submitted that the deceased committed suicide due to having illicit relationship before marriage. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para-3 of the bail petitioner. The petitioner is in custody since 11.04.2024.

Learned counsel for the respondent as well as learned A.P.P. for the State have opposed the bail petition of the petitioner and submitted that the petitioner committed murder due to non-fulfillment of demand of dowry. In post-mortem report also, the doctor has found oblique, non-continuous ligature mark present on nape of neck extended towards both side of neck and also found ligature bruise present below left side and kept opinion reserved.

6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of offence against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Kasba P.S. Case No.

Patna High Court CR. MISC. No.18558 of 2025(3) dt.14-07-2025 3/3 78 of 2024, pending in the Court of learned A.C.J.M. IInd, Purnea.

7. Learned court below is directed to conclude the trial of the petitioner at the earliest.

8. The application stands rejected.
