2. Heard learned counsel for the petitioners as well as the learned APP for the State.

3. The petitioners apprehend their arrest in connection with Kawakole P.S. Case No. 331 of 2024, registered for the offences punishable under Sections 305(e), 317(4) of BNS, 2023.

4. As per allegation, the tractor's driver tried to flee away, after unloading the illegally mined sand. The allegation against the petitioner is that he, along with other co-accused, was involved in illegal mining of the sand.

5. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. They are the persons of clean antecedent and on similar allegation, other co-accused persons have been granted anticipatory bail by the coordinate Benches of this Court.

6. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist, Nawada in connection with Kawakole P.S. Case No. 331 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) kundan/- U T
