Admittedly a petition filed under Section 125 Cr.P.C. and was registered as maintenance Case No. 18 of 2010. Final judgment was pronounced and prayer for maintenance of petitioner No. 1 the wife was rejected though the children were allowed maintenance. Against the order of maintenance a revision under Section 19(4) of the Family Courts Act would lie. As such, this appeal is not maintainable.
However, the appellant is permitted to convert this Memorandum of Appeal into criminal revision under Section 19(4) of the Act within a period of two weeks, failing which this appeal shall stand dismissed without further reference to a Bench. (Dr. Ravi Ranjan, J) (S. Kumar, J) veena/- U
