JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-06-2020 The petitioners, who are in custody since 14.10.2019, seek bail in connection with Bakhri P. S. Case No. 157 of 2019 dated 04.06.2019 instituted for the offences under Sections 457, 307, 326, 387 and 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.
The petitioner no. 1 is the son of the informant
Patna High Court CR. MISC. No.16520 of 2020(2) dt.01-06-2020 2/3 from his first wife whereas petitioner no. 2 is an associate of petitioner no. 1.
It has been alleged that the petitioners were spotted by the informant as having shot him. The petitioner has received two gun shot injuries. It has been urged on behalf of the petitioners that an absolutely false case has been instituted by the informant who is not willing and desirous of maintaining his first wife i.e. the mother of petitioner no. 1. Because the petitioner no. 2 is the friend of petitioner no. 1, he too has been made accused in this case.
The occurrence is said to have taken place in the dead of the night and there does not appear to be any source of identification. There is no other eyewitness to the occurrence as well. Considering the nature of accusation and the period of custody of the petitioners, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two
