JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under sections 366A and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that admittedly the petitioner is not one of the persons who abducted the victim Puja Kumari, who is alleged to be minor aged about 14 years. However, in the supplementary affidavit it is stated that the victim is a major.

Learned counsel for the State submits that the victim in her statement under section 164 Cr.P.C. has made allegation against the petitioner.

Having regard to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. The prayer

Patna High Court Cr.Misc. No.38053 of 2014 (5) dt.03-07-2015 for anticipatory bail of the petitioner is rejected. However, if the petitioner surrenders and pray for regular bail, the same would be disposed of on the same day without prejudice and also taking into consideration that the petitioner was not one of the persons who abducted the victim girl.
