None ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-01-2021 Heard Mr. Bajrangi Lal, learned Counsel for the petitioner. No one appears on behalf of the State. This application, for grant of anticipatory bail, arises out of Atri Police Station Case No. 60 of 2019, disclosing offences under Section 409 of the Indian Penal Code. The allegation as per the First Information Report is that petitioner being Panchayat Secretary did not provide folder of relevant documents regarding selection of Panchayat Teacher in Chakra and Narawat Panchayat for appointment in the year 2003 to 2006.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of false and concocted allegation inasmuch as petitioner was

No.16315 of 2020(2) dt.18-01-2021 2/3 posted in Chakra in the year 2006 and thereafter he was transferred to Imamganj Panchayat and submitted his charge in favour of his successor, Ram Pravesh Yadav about more than 13 years back. Learned counsel next submits that at present, the petitioner is posted in Imamgang Panchayat and the folder containing documents regarding appointment of Teacher in Chakra Panchayat has been demanded in the year 2018 while petitioner was not posted there. Learned counsel next submits that co-accused persons have been granted bail by this Court in Cr. Misc. No.15000 of 2020 dated 02.07.2020 and Cr. Misc. No.10082 of 2020 dated 02.03.2020 respectively.

Having regard to the submissions made on behalf of the parties and taking into consideration the materials and the fact that petitioner was not working in Chakra Panchayat and Narawat Panchayat at that time when the Vigilance Department, Gaya demanded relevant documents on 01.09.2018 and the similarly situated co-accused persons have been granted bail by this Court, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, Lalan Ravidas, in the event of his arrest or surrender before the Court below within six weeks, be

No.16315 of 2020(2) dt.18-01-2021 3/3 released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Atri Police Station Case No. 60 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

It is made clear at the time of furnishing bail bond, all the parties shall follow the guidelines regarding social distancing.
