2. The present petition has been preferred for the following relief/s:
(i) for issuance of an appropriate writ/ writs, order/orders, direction/directions to the Circle Officer, Nokha (Respondent no.
3) to register their name in the Register-II in favour of the petitioners in respect of Mauza-Dudhar, Thana no. 433 Govt. Land
Patna High Court CWJC No. 5805 of 2025(2) dt.21-04-2025 2/3 Anabad Sarvsadharan Khata no. 130, Khesra No. 749 and an Area of 01.60 decimals, who are in their possession since 90 years and they have constructed a Kacha House and Pacca House upon the said land being a landless person of S.C.
category and they live of their family members peacefully and Respondent no. 3 has not taken any interest in the matter of grievance of the petitioners due to which any scheme for the caste of SC and ST under State of Bihar not useful.
3. Learned counsel for the petitioners submit that they are landless people residing at a particular place and are being threatened of eviction.
4. Learned counsel for the State on the other hand submits that if they are landless people, the State has a role to play in the matter but the petitioners cannot insist on a particular land.
5. This Court is in full agreement with the view of the learned State Counsel, if the petitioners have real grievance that they are landless people, they should approach the Collector,
Patna High Court CWJC No. 5805 of 2025(2) dt.21-04-2025 3/3 Rohtas at Sasaram (respondent no.2) for the redressal of the grievance instead of insisting on a particular piece of land.
6. In that background, learned counsel for the petitioners submit that they shall be approaching the respondent no.2, Collector, Rohtas at Sasaram in next four weeks.
7. If such representation is filed, the same should be taken to its logical conclusion at an earliest by the respondent no.2.
8. However, it is made clear once again that the petitioners cannot insist on the particular land in question.
9. The writ petition stands disposed of.
