2. The petitioner apprehends his arrest in connection with Nawada Town P.S. Case No. 1150 of 2024, registered for the offences punishable under Section 87 of the BNS.

3. On 29.09.2024, at about 11:40 AM, the informant's daughter left her house but did not return. The informant has suspicion that the petitioner has kidnapped her daughter.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The petitioner is mother of main accused Shivam Kumar, against whom there is allegation of kidnapping of minor

He has submitted further that the victim, in her statement under Section 183 of BNSS, did not support the prosecution case. She has stated that her father wanted to solemnize her marriage with another persons, as such, she went with co-accused Shivam Kumar, according to her own sweet will.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 1150 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
