ANJANA MISHRA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 120(B)/420/406 of the Indian Penal Code.
Learned counsel for the petitioner submits that the dispute between the parties arose on account of the fact that marriage of the petitioner has been settled with the daughter of the informant and subsequently, things went wrong and ultimately it was broken off. Petitioner being the bridegroom has been implicated in the present case thought he had not at all taken part in any of the negotiations and only because it was his marriage, his name has been brought in the present case. Final form has also been submitted in this case whereas petitioner has not been sent up for
Patna High Court Cr.Misc. No.32732 of 2015 (2) dt.18-08-2015 P2/2 trial while the father of the petitioner has been extended the privilege of anticipatory bail by an order of this Court dated 20.03.2015 passed in Cr. Misc. No. 41134 of 2014. Considering the facts and circumstances of the case and also the nature of allegation made against the petitioner, let the petitioner, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 137 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
