====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-08-2018 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Kotwali (Barari) P.S. Case No. 231 of 2018 registered for the offence punishable under sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. No specific allegation against the petitioner. Moreover, similarly situated co-accused has been granted bail by a co-ordinate Bench of this Hon'ble Court vide order dated 06.08.2018 passed in Cr. Misc. No. 42605 of 2018. Petitioner is in custody since 10.04.2018.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.50138 of 2018(2) dt.14-08-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 231 of 2018.
