JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner seeks bail in connection with Case No. C2/123/2020 dated 13.02.2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the prosecution report that 45 litres of Nepali liquor was recovered from the possession of the petitioner. The petitioner claims to have been falsely implicated because of local enmity. On the alleged date of occurrence, it has been urged, the petitioner was coming from local market and he was arrested on mistaken identity as many persons were found fleeing

The petitioner has clean antecedents and he is in custody since 13.02.2020.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II cum Special Judge, Excise Act, Sitamarhi in connection with Case No.

C2/123/2020.
