2. The petitioner apprehends his arrest in connection with Bathnaha P.S. Case No. 392 of 2024 registered for the offence under Sections 127(2), 115(2), 109(1), 103(1) and 3(5) of B.N.S.

3. As per the prosecution case, petitioner and others are said to have assaulted the victim causing murder of the deceased.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. It is next submitted that there is general and omnibus allegations against the petitioner who is a 77-year-old man. Petitioner has clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the age and allegation against the petitioner, this application is allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Bathnaha P.S. Case No. 392 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS. (Sandeep Kumar, J) tusharika/- U T
